中国法律文化概况

《中国法律文化概况》兼具实用性和学术性，既可用于课堂教学和课外阅读，又可以作为参与中国经济文化建设的外国人士了解中国法律文化知识的工具书和学术工作者对该领域进行全面而系统研究的参考书。《中国法律文化概况》分为十六个章节，主要包括中国的法律思想、法律体系、法律理论、法律意识、立法成就、司法理念、中国当代社会的挑战、近现代中国受到西方法律文化的影响、行政法、社会法、民法、刑法和经济法等诸多领域的内容。《中国法律文化概况》适用范围广泛，不仅对国际留学生和国内法律文化双语课程教学不无裨益；对于在中国企业工作或与中国企业进行合作的外国实践者，此书提供的法律文化知识也具有启发和借鉴作用。

伍巧芳，法学博士，现任华东政法大学教授，外语学院副院长。研究方向为金融监管、中国法律文化和法律翻译。曾主持国家社会科学基金项目1项、省部级项目2项，参与国家社会科学基金重点项目1项。在《法学》《辞书研究》《江西社会科学》《光明日报》等核心期刊报纸发表论文30余篇。在国家级出版社出版专著和译著10余部。

前言本书作者多年从事“中国法律文化”课程的教学工作，授课对象为来自世界各地的外国留学生。随着中国经济的蓬勃发展和“一带一路”倡议的实施，越来越多的国际学生对中国的传统法律文化和现代法律文化产生了浓厚的兴趣。而一直以来本课程均未有现成的教材，故笔者认为很有必要编写一本英文版中国法律文化的教材。作者经过9年的教学实践，积累了丰富的教学资料。在此基础上，综合国内外权威出版社出版的法律文化著作，兼顾国际留学生、与中国各行业和各领域进行实践合作的外国人士以及学术研究人员等不同层次读者的需求，全面系统地介绍了中国传统法律文化向现代法律文化转型的诸多方面。本书将帮助读者深入了解中国法律文化的特色及其对社会主义法治的影响。《中国法律文化》兼具实用性和学术性，既可用于课堂教学和课外阅读,又可以作为参与中国经济文化建设的外国人士了解中国法律文化知识的工具书和学术工作者对该领域进行全面而系统研究的参考书。本书分为十六个章节，主要包括中国的法律思想、法律体系、法律理论、法律意识、立法成就、司法理念、中国当代社会的挑战、近现代中国受到西方法律文化的影响、行政法、社会法、民法、刑法和经济法等诸多领域的内容。本书适用范围广泛，不仅对国际留学生和国内法律文化双语课程教学不无裨益；对于在中国企业工作或与中国企业进行合作的外国实践者，此书提供的法律文化知识也具有启发和借鉴作用。笔者在此要特别感谢德国科隆大学何意志教授、香港法律学者陈弘毅教授和复旦大学郭建教授，因为他们的论著和课程为本书提供了灵感和重要的素材。在本书的编写过程中，感谢华东政法大学国际交流处姜丹老师和田华老师提供大力支持，感谢法律出版社的解锟编辑，她的敬业精神和细致耐心让作者印象深刻。由于本书的原始资料多为中文，因此在编写过程中涉及大量的翻译工作，笔者在此对参与翻译的华东政法大学外语学院的研究生潘佳璐、丁沁晨、孙锁雨、季培雯和叶星星等同学表示由衷的感谢！笔者的知识水平有限及其他客观原因，本书难免会存在一些纰漏和错误，恳请广大读者不吝赐教，提出宝贵的意见和建议，以便不断改进。伍巧芳
